Omaha Truck Accident Attorney

If you were in a passenger vehicle and had an accident with a large commercial truck, chances are you were seriously hurt. When a fully-loaded, 80,000 lb semi tractor-trailer collides with a 3,000 lb passenger vehicle, it is not usually the truck driver who suffers the most serious injuries.

The National Highway Traffic Safety Administration (NHTSA) reports that in 2015, there were 4,067 fatalities in accidents involving large trucks on U.S. roadways – a 4.1% increase over the previous year. Of those people who lost their lives, 73.5% were occupants of other vehicles and 10.1% were non-occupants (pedestrians or bicyclists). Only 16.4% of the people who died were occupying the large commercial trucks.

At Bottlinger Law L.L.C., we serve Nebraska, Iowa, and Texas; providing personalized legal services to people who have been injured in truck accidents. Our founding attorney, Jason Bottlinger, has been awarded membership in the Million Dollar Advocates Forum and the Multi-Million Dollar Advocates Forum, elite groups of attorneys who have achieved high-value settlements and verdicts. You can rely on us for the skilled and dedicated representation you need after a serious accident with a semi tractor-trailer.

Causes of Truck Accidents

Although truck drivers are less often seriously hurt in collisions with passenger vehicles, they are all too often the driver responsible for the accidents. As stated in the Large Truck Crash Causation Study Analysis Brief published by the Federal Motor Carrier Safety Administration (FMCSA), of all the large trucks studied that were involved in single and multi-vehicle accidents, 55% of the trucks or their drivers were assigned the critical cause for the crash.

Researchers in this large study found that the top 10 factors in traffic accidents associated with the large trucks and their drivers, in descending order, were:

  • Truck brake problems
  • Interruption of traffic flow (traffic congestion or a wreck)
  • Driver prescription drug use
  • Truck travelling too fast for conditions
  • Driver unfamiliar with roadway
  • Roadway problems
  • Driver required to stop before crash (crosswalk, traffic controls)
  • Driver over-the-counter drug use
  • Driver inadequate surveillance
  • Driver fatigue

Get Legal Representation with Experience After a Truck Accident

After a serious truck accident, it is vital to have an Omaha auto accident attorney representing you who has experience with this type of case. Truck accident claims are complex cases involving federal regulations, multiple potentially responsible parties, and teams of attorneys representing the other side. The lawyers and insurance companies for the other side will try to show that the accident was not caused by the truck driver or trucking company, or will try to convince you to accept a lowball settlement out of court.

At Bottlinger Law L.L.C., our founding attorney began his career defending insurance companies in high-dollar disputes. The in-depth knowledge of how the other side operates he gained from that experience gives him an edge in representing individuals in personal injury matters, including truck accident claims against large trucking firms. If you or your loved one has been seriously hurt in a collision with a tractor-trailer, contact us to schedule a free consultation at (402) 505-8234. We can tell you if you have a case and what damages you may be able to claim.
